About the Role
You will advise on CFTC implications for new features, draft and negotiate FCM agreements and disclosures, prepare regulatory submissions, monitor CFTC and NFA developments, advise on FCM policies, and support litigation strategy involving FCM operations and exchange regulation.
Requirements
- J.D. and active U.S. bar membership
- 3 to 7 years of FCM-focused legal or compliance experience
- Deep knowledge of the Commodity Exchange Act CFTC regulations and NFA rules
- Knowledge of FCM segregation net capital and margin requirements
- Ability to write clear and persuasive comment letters no-action requests and customer agreements
- Experience contributing to business and product decisions early
- Strong judgment under regulatory uncertainty
- Direct experience with CFTC examination or enforcement processes
- Familiarity with prediction markets or event contracts is a plus
- Interest in emerging financial technologies and market structure is a plus
Responsibilities
- Advise product and business teams on CFTC implications
- Draft and negotiate customer-facing FCM agreements disclosures and documentation
- Prepare responses to CFTC and NFA inquiries and examinations
- Draft comment letters no-action requests and interpretive submissions
- Track CFTC enforcement actions rulemaking and NFA notices
- Advise on segregation net capital margin and customer protection requirements
- Support litigation strategy involving FCM operations and exchange regulation
